import export HS tariffs and licensing / digital image files

hi, would we have anyone with knowledge on import export of image files for reproduction? Upon checking the Harmonised System (HS classifications codes / the working tariff) at customs, it seems digital files haven't quite made it there yet. I've chosen to interpret my digital files as 3705.10.00 which is defined as Photographic plates and film, exposed and developed, less cinematographic: as for all practical reasons our digital files serves the same purpose as that defined.
All torunnphotographs are traded on a per license basis, but you still need to import / export the "hardware" to enable reproduction? Or is there an altogether different approach to this as we deal with intellectual property and licensing?

Comments anyone? Would we (ACMP) have a knowhow on this to clarify?

Thanks Stefan, I appreciate your help. And great advice on the licensing issue, I'd never have thought to negotiate with a client that way. It's a win-win isn't it? I get to keep the copyright and they get an assurance my images won't pop up on a competitor's website. Thanks again.

No. I never give anyone RAW files either for all the reasons already mentioned plus the fact there is value-adding to be gained from additional post-production fees.

Hi Darren,

Normally it would extend to 'similars' from the shoot, much in the same way as if you were submitting a stock submission to a library on an 'image exclusive' basis where you then couldn't submit similar images to those chosen, from the same shoot, to another library.

I'm imagining your client is wanting to purchase the copyright either because they want to save money from on-going licensing or they don't want a competitor using the images, or for both reasons. If you think the images have further licensing potential you can point out to them that as part of your professional ethics you mange any licensing conflicts so there is no need for them to be concerned. In other words, you'll retain copyright in the images they don't purchase, but you agree not to license the images to third party's in the same industry. You can negotiate this in various degrees if you want, such as territory and duration. For example, you may agree to not license the images to a similar industry in Australia only for a period of 3 yrs. They're your images so it's all down to negotiation.

I was recently commissioned to shoot a specific number of images for a client who wanted to buy the copyright to the images, to which I agreed (for a price) but now the client wants to know if the copyright extends to the entire batch of images I sent through in the form of contact sheets. I sent the proof sheets through so the client could choose the images it wanted, thus reducing their post production costs. When I sell the copyright to a client based on them wanting a specific number of images do I still own the copyright to the images they haven't chosen?

I wouldn't hand out a RAW file, but that is just me on principle. When people ask me about RAW files I explain it like this.

RAW is like having put all the cake ingredients together, all the extra little bits and pieces of your special recipe, folding, beating, pre heating the oven to the perfect temperature, putting the amazing cake mix into your chosen baking dish and then skipping the cooking section and handing that 'mix' to your client.

It's good and could be eaten like that, but imagine how incredible it would be if it were cooked, cooled, iced, then finally cut into the exact size and a little cream or ice cream added. Mmmmmm spectacular.

I've got an issue with a client of mine and would really like to make this public:
I have been shooting for BOX Magazine (fashion/socials magazine) they pay $200 per job to get 10 pictures of well dressed people at events.They also pay $200 for a portrait shoot. Nice and pleasant job and a good extra cash if you are starting out as an emerging photographer.

Hi Hannah,

Average pricing for a NGO/Charity if they were buying a stock image for the usage you have outlined is: $650. - $1,150. for a print run of 1000, Australia only for 12 months.

Then of course it's entirely up to you on how much you want to 'donate' to them in terms of reducing this figure.

Usage costs

Hi everyone,

I was hoping someone might have some experience or can help me out with this situation.

I recently was hired by a company to shoot a 'behind the scenes' of a charity TVC that was being filmed and the shots being for the clients record of the shoot.

They now want to use one of the images for a poster that will be seen nationally and associated with a large brand who support the charity.

I am not sure what sort of price I should be negotiating or expecting for this as it was not discussed initially, and it is also to promote a charity so I don't mind doing a cheaper rate but I also don't wish to be taken advantage of. What would be a fair price for this sort of usage?

Any advice or thoughts would be greatly appreciated!

Live Streaming

Wondering if the ACMP board have looked into live streaming of events, such as the upcoming one on creativity. As a member not in either of the "big two", Melbourne or Sydney, there really isn't anything going on for members outside those two cities and live streaming it seems to me would be a good option to address this.The AIPP have recently used it to great success for the APPA judging. It is pay per view and in the ACMP's case members would probably have to register and pay in advance so the ACMP could guarantee it would be viable.

Selling RAW files???

So, just completed a job to specifics of the initial contract - shoot and provide an online proof gallery to agency. The next step of the contract was to provide a Hi-res file ready for print of an image selected from the proof gallery.

The agency now wants all of my RAW files so they can process, retouch them and provide the final hi-res files to client. Does anyone do this - what sort of costs can I charge, is this unethical? I have never in my career been asked for my RAW files. I feel as my RAW files are my 'notes' from a shoot to provide me with the basis to create an image - more pointedly my image.

Any advice would be most appreciated.

I think the AIPP did a survey earlier this year called 'Normal' which may help. It was a survey to find out what and how photographers normally charge.

I don't know if it is out yet. I am also a member of AIPP but I find their website quite uncoordinated. I have just emailed them and will post their response.

Have you read the ACMP Better Business Bible? I'd start there.

The 2 most common methods are charging per image OR per hour. Both have pros & cons. Your experience & equipment used are factors to consider when formulating a rate. Some photographers charge between $10-20 per image for very basic retouching OR $75-$300 per hour for heavy retouching & compositing.
